TERMS AND CONDITIONS

By engaging the services of Valley DJ (VDJ) for my event, I hereby acknowledge and agree that all services provided to me by VDJ, will be delivered strictly in accordance with the following terms and conditions. I understand and acknowledge that it is my entire responsibility to read, understand and agree to each and everyone one of the following terms and conditions.

  1. ACCESS TO SERVICE TERMS AND CONDITIONS
    I irrevocably confirm and agree that VDJ has provided me with the opportunity to view, read, understand, agree and/or decline the VDJ Service Terms and Conditions on the VDJ website before confirming my reservation, and before transmitting the nonrefundable deposit to VDJ to secure VDJ entertainment services for my event.
  2. NO PAYMENT PRIOR TO AGREEMENT
    I hereby provide an irrevocable guarantee and irreversible agreement to VDJ, that I did not proceed with my online registration, or pay the required non-refundable deposit before reading, understanding, and or seeking professional legal advice. If I waive my right to obtain legal advice in respect of the following terms and conditions, I understand and agree it will in no way affect or diminish my entire responsibility to comply with each and every Service Term and Condition.
  3. SERVICE TERMS ARE BINDING
    I understand, acknowledge, and agree that by purchasing a reservation with VDJ, that I am legally bound by the following Service Terms and Conditions from the time of completing my online reservation and agreeing to the VDJ Service Terms and Conditions. Therefore, I hereby provide an irrevocable assurance and agreement to VDJ, that I will act in accordance with the following Service Terms and Conditions at all times from the time I complete my online registration.
  4. SERVICE TERMS AND CONDITIONS UPDATE
    I understand and agree that VDJ may update, change or enhance the VDJ Service Terms and Conditions to meet the changing needs of the business, economic, pandemic or other conditions as and when necessary. I agree that I may be required to sign an additional updated version of the VDJ Service Terms and Conditions before if an update is required.
  5. COMPLAINTS
    I understand that in the unlikely event that I have a complaint regarding any aspect of VDJ service, I will initially refer to and apply the VDJ Service Terms and Conditions to resolve my complaint. I irrevocably agree not to make or maintain complaints about any item that is already either contemplated or outlined in the VDJ Service Terms and Conditions. If an event occurs that is not contemplated in the Service Terms and Conditions professional arbitration may be required.
  6. RESERVATION CONFIRMATION
    I understand and agree that VDJ will only accept reservation requests via the VDJ dedicated booking/reservation portal provided on the VDJ website at
    www.vallydj.com.au. I understand and agree that attempted service reservations made by telephone or email or any other form of communication are void and completely invalid, and will not be honoured under any circumstances.
    When I make a formal reservation with VDJ via the website, I agree that I will be required to make a non-refundable deposit payment to formally secure my reservation. The deposit is non-refundable given that VDJ will accept my booking and decline all other bookings for the same date.
  7. CONTACT BEFORE MY EVENT
    I understand and agree that VDJ will initiate contact with me in respect of my event fourteen (14) days prior to the event, but not before. This allows me the opportunity to finalise all of my event plans which may change over time, and to only communicate my final plans to VDJ. I understand that I am welcome to contact VDJ anytime during business hours five (5) days per week via telephone or email if I have questions, queries or concerns or need support of any kind.
  8. SITE INSPECTIONS | DJ MEETINGS
    I understand and agree that pre-event meetings and site inspections are not included or costed within my selected package. As such, I understand and agree that if I require a meeting with any member of the VDJ team, or I request VDJ team members to inspect my venue before my event, I will be charged a minimum fee of one hundred and fifty dollars for inspections within twenty (20)km from Pokolbin NSW 2325. Site inspections and meetings conducted outside of a twenty kilometre (20km) radius of Pokolbin in the Hunter Valley will require me to pay two dollars and thirty cents $2.30 per kilometre, plus a flat rate of $50 per hour or part thereof for travel and labour. I agree for these travel and time costs to be added to my account which I will pay no later than thirty (30) days prior to my event.
  9. EVENT DETAILS
    I agree and accept the responsibility for providing, checking and verifying the address contact and other information I provide to VDJ in respect of attending my event. It is not the responsibility of VDJ to verify any address or contact details provided by me at any time. I agree to provide VDJ with all the relevant details at the time of completing my reservation. If I am unaware of certain information at the time of initially securing my reservation, I will provide the information at the earliest opportunity.
  10. DEPOSIT PAYMENTS
    I acknowledge understand and irrevocably agree that a fifty per cent (50%) nonrefundable deposit equal to the amount of my entire preferred package, including all optional extras I purchase, is payable to secure the professional services of VDJ.
  11. BALANCE OF PAYMENTS
    I irrevocably agree and completely accept that any balance remaining on my account must be paid in full thirty (30) calendar days before my event date. I agree that in certain circumstances I will be provided with a fourteen-day payment grace period, after which time if my payment has not been received by VDJ in full, that VDJ will charge me a late payment fee of one hundred dollars ($150) which I agree to pay without reservation or delay.
  12. ACCOMMODATION
    In the event I request VDJ to provide service to me beyond midnight, I agree that I am responsible to secure and pay for at least four (4) star hotel accommodation standard for the VDJ staff member in attendance at my event.
  13. MEALS
    I hereby agree to provide my VDJ staff member with a service meal when in
    attendance at any event where my guests are provided with any kind of meal, either sit down or cocktail style. I understand this is a standard requirement and courtesy of the events industry, given that event workers are unable to take time to have a meal of their own while attending my event.
  14. ARRIVAL TIMES
    I understand and agree that VDJ will arrive at my event venue to commence setting up the sound and lighting equipment one (1) hour before my reception commences but not before. If I require VDJ to arrive earlier than one hour, additional charges will apply. I agree that this is necessary given the additional attendance time that is not included in my original package.
  15. SET UP AND PACK UP TIMES
    I agree to ensure that VDJ is provided with a setup and pack down window of two hours before and after the event.
  16. EARLY SET UP TIME
    I understand and agree that if for any reason I require VDJ to set up entertainment equipment any earlier than one hour before the scheduled entertainment start time that additional labour fees will apply. I agree to pay any such quoted fees not later than fourteen (14) days prior to my event date.
  17. OH&S
    I understand and agree that is it my responsibility to provide VDJ with a safe and secure area to conduct entertainment services. The area must be 3m x 3m square or nine (9) meters square overall, in an undercover, waterproof area. It is my entire responsibility to provide crowd control if needed and I will ensure that any intoxicated guests are not permitted to harass or intimidate VDJ team members.
  18. POWER REQUIREMENTS
    I understand and agree that it is my entire responsibility, not the responsibility of VDJ, to procure a minimum power outlet of at least 20amps. I acknowledge that where possible, I am to provide two ten (10)amp outlets which are preferred by VDJ.The power cable/s are to be covered to prevent tripping hazards and must be procured by me from my venue, while also ensuring all venue OH&S requirements are met orexceeded. I confirm that I both understand and agree that is it not the responsibility of VDJ to procure the correct power supply from the venue of my choice.
  19. VENUE CHARGES
    I understand, accept and agree that any related power or engineer costs associated with the supply of the correct and adequate power supply to VDJ is at my own expense and not at the expense of VDJ.I agree to reimburse VDJ within thirty (30) days of my event for expenses imposed by the venue which include but are not limited to: parking, meals, electric use, fire call outs, noise complaints, or fines issued etc.
  20. PURCHASING OPTIONAL EXTRAS
    Any optional extras that I purchase must be paid for in full thirty (30) days prior to my event.
  21. UPGRADING MY PACKAGE
    I agree that I may upgrade my package at the complete discretion of VDJ subject to the confirmation of equipment allocation. If I desire to upgrade my package, I must provide a detailed email to VDJ to confirm my purchase. Any upgraded components will be added to my final account which must be paid thirty (30) days before my event.
  22. FOG MACHINES
    If I have included a fog machine with my package I understand and agree that it is my entire responsibility to gain written permission from the venue management and provide such approval documentation to VDJ no less than 14 days before my event.Fog machines can set off smoke alarms which trigger the attendance of the Fire Brigade resulting in expensive fines being issues to the venue and to VDJ. Therefore should I include the option of a fog machine, I agree to provide VDJ with a complete and full financial indemnity from any infringement issued in respect of triggered smoke alarms.I irrevocably agree that should I include a fog machine in my package and VDJ is subsequently prevented to use the fog machines in the venue by the venue, I will not be entitled to a refund of the equipment upgrade.
  23. DOWNGRADING MY PACKAGE
    I understand and agree that I am permitted to downgrade my choen package at any time up until one hundred and twenty days (120) days before my event date. I agree that package downgrades are not permitted one hundred and twenty (120) days or less before my event. I recognise and further agree that VDJ could have otherwise rented or used the equipment that was originally allocated to me. If I downgrade my package within one hundred and twenty (120) days of my event, it could result in VDJ incurring losses which I could be liable to pay to VDJ.
  24. OVERTIME CHARGES
    If I require unexpected overtime on the evening of my event, I agree I must first contact the VDJ office on the evening of my event and pay the relevant over-time fees over the phone using a valid credit card. I confirm I will not provide any cash payments to the VDJ staff member in attendance at my event. I will contact VDJ and make the payment using a valid credit over the phone before overtime commences. I agree that I will not request the extension of entertainment services (overtime) unless I agree to make full paying first.
  25. MUSIC CHOICES
    I understand and agree that I am not permitted to choose each and every song played during the evening of my event. I am the customer “yes”, but I am not the DJ. I have engaged the services of a professional entertainment company that will assess the ages and responses to certain music played at my event, to ensure that the majority of people at my event are enjoying the music selection. I confirm and agree that I will do everything in my power to protect VDJ team members from guests either harassing, bullying or intimidating VDJ team members in relation to music choice.
  26. MUSIC VOLUME | NOISE RESTRICTIONS
    I understand and accept that some people at my event will think the music is too loud, while others will feel it is not loud enough. Therefore I understand that VDJ will work with my venue to abide by any noise restrictions or noise considerations provided by the venue or by law, while also balancing the need for guest satisfaction. I agree to prevent any of my guests from harassing, bullying or intimidating VDJ team members in relation to music volume.
  27. GENERAL MUSIC PLAYLIST
    I understand that VDJ will accept a music playlist from me, however, I agree that not all songs on the playlist will be played for various reasons. I agree that VDJ will do their best to play as many songs on my song list as possible during my event. I agree that I will not be entitled to a refund or any form of compensation if VDJ fails to play any of my requested songs or songs requested by my guests.
  28. SPECIFIC SONG PLAYLIST
    I understand and agree that in the event I require specific music to be played at certain times during my event, that I will provide VDJ with all the relevant information thirty (30) days before my event. In certain circumstances, if advised by VDJ, I may be required to provide song choices on USB in a particular format.
  29. USE OF MOBILE PHONE
    I accept and agree that VDJ staff members are permitted to use their mobile phones while playing dinner music or while guests attending my event are eating or socialising (not dancing). Mobile phones are used to search or stream music or made available to provide entertainment to VDJ staff members during long periods, sometimes many hours, playing background music. The use of a mobile phone does not indicate that the VDJ staff member is not attentive or delivering the required service of playing music and providing entertainment in accordance with these Service Terms and Conditions.
  30. EMERGENCY SERVICES CALL OUTS
    In the event I have requested a fog machine to be supplied by VDJ at my event and any such use, either authorised or unauthorised, triggers fire brigade attendance or any other emergency services to attend the venue, that I agree to completely indemnify VDJ from any and all infringements.
  31. CANCELLATION AND REFUNDS
    In the event I cancel my reservation with VDJ I understand accept and agree that the following fees will apply.Cancellations with more than one hundred and eighty-three (183) days (6 months) advanced notice will receive a full refund less bank merchant fees.
    Where I provide less than one hundred and eighty-three (183) days (6 months) of advanced notice to VDJ, agree that my non-refundable deposit will be forfeited.If I cancel the services of VDJ within fourteen (14) days of my scheduled event, I agree that I will be required to pay the remaining balance of my initial reservation totalling 100% of the original booking value as invoiced. I hereby provide VDJ with an irrevocable financial guarantee to pay the remainder of my service invoice within seven (7) days of my cancellation notice being provided to VDJ. This guarantee is provided by me to VDJ in recognition that the VDJ employs multiple staff, incurs substantial costs and incurs losses for late cancellations.
  32. POSTPONEMENTS
    Should I decide to postpone my event for personal reasons, which are not a result of any government-mandated lockdown, I agree that a rebooking fee of one hundred and fifty dollars will be added to my account.
  33. COMPLAINTS
    If I have a complaint about the service provided by VDJ, I agree to email my completion to VDJ: info@valleydj.com.au. I agree that VDJ will not investigate any complaint not provided in writing. I further agree to allow VDJ fourteen days to investigate and respond to my complaint which will be provided in writing. I agree not to make any complaint against VDJ for issues that are contemplated in the Service Terms and Conditions, given that I have already agreed to accept the various Service Terms and Conditions.
  34. DISPUTE RESOLUTION
    I understand, acknowledge and agree that if a dispute arises in relation to the service provided to me by VDJ, I will refer to the Service Terms and Conditions for guidance. I agree that I must first contact VDJ with details of my complaint and provide VDJ with a minimum of 14 days to investigate and respond to my complaint.If an event has occurred that is not contemplated within the Service Terms and Conditions and a dispute that arises between myself and VDJ cannot be resolved together, I agree to contact The NSW Department of Fair Trading for Advice and guidance. In contacting the Dept of Fair Trading I agree that it is my responsibility to advise the Department that you have entered into a service agreement with VDJ and I agree to provide a copy of the VDJ Service Terms and Conditions to the Department of Fair Trading.
  35. DEFAMATION
    I irrevocably agree to act in accordance with the defamation Act 2005 No. 77.
    I accept and agree that unreasonable, unverified or un-arbitrated negative comments and or negative reviews of VDJ’s service, will cause VDJ significant financial losses and significant damage to its overall reputation. Therefore, for the avoidance of doubt I hereby irrevocably and irreversibly agree that I shall not, directly or indirectly, make or ratify or allow any guest of my event, family member or acquaintance to make any defamatory comments or remarks (in writing, orally, verbally or in any electronic form), including any form of social media relating to VDJ, or the services provided by VDJ, or services provided by any other related party to VDJ’s respective service partners.I hereby acknowledge and further agree that by making any defamatory statements, including negative reviews about VDJ’s service in any form, that I could be in breach of the Defamation Act 2005 No. 77, which could result in VDJ commencing defamation action against me, and me being liable to pay significant amounts of financial compensation to VDJ plus any legal fees.
